Renewal SOP

Step 1:  Approximately 45-60 days prior (sometimes more) of any lease expiration our team will proactively draft a renewal option letter (see the below sample).  We send this to you for your review, approval, and/or adjustments.  Keep in mind, when coming up with "suggested" rates we are taking into consideration not just current market trends/comps but also the tenant history, current economic outlooks, current property/owner threshold for vacancy, etc.  These are both data driven and tenant experience "suggestions only" by no means are you bound to our numbers, simply let us know what you are comfortable with or adjustments you would like to make.

Step 2: Once the letter is approved, we will proactively send out the renewal letter via regular mail and certified mail. If the tenant fails to renew, the rent is automatically increased to the month to month option effective the date listed in the letter after a proper 30 day notice.

FAQ:

If the tenant goes month to month, how long are they able to proceed that way?

Once the tenant goes month to month, they will remain month to month unless you proactively contact us to either send another renewal option letter in the future and/or termination notice.  You may request this at anytime and we are happy to run current comps and/or draft a fresh rental option letter.

I don't want a month to month tenant, can I force them to only sign a new lease?

Our lease and (ARS 33-1375) requires a 30 day written notice by either party to terminate the lease after expiration (periodic tenancy) otherwise the lease automatically defaults to a month to month status.  With this, of course we cannot force a tenant to renew the lease thus we need to have something provided in writing should they fail to renew as to what the month to month rate would default to (generally a premium).  If the tenant fails to renew and you as a landlord do not wish to continue on a month to month basis you can subsequently provide an additional 30 day notice to terminate the tenants lease agreement.
